Terms of Service
Last updated: October 14, 2026
These Terms of Service (the “Terms”) govern your use of TRACKFIGHT (the “Service”), operated by Yevhen Besiedovskyi (“we”, “us”). By signing in or otherwise using the Service you agree to these Terms. Our Privacy Policy explains how we process personal data; accepting these Terms does not constitute consent to optional tracking. If you do not agree, do not use the Service.
01Who can use the Service
The Service is exclusively for adults aged 18 or over who have reached the age of majority in their country and can enter into a binding agreement. People under 18 may not use the Service, including with parental permission. You must also comply with Twitch’s Terms of Service and Community Guidelines.
02The Service
TRACKFIGHT lets streamers run track battles: viewers submit tracks, two tracks compete, and the chat of the streamer's Twitch channel votes. It provides public arena pages, tournament brackets and overlays for streaming software such as OBS. The Service does not host, store or stream music: tracks are links to, or embedded players of, third-party services.
03Accounts
Sign-in is available only through Twitch and does not create an arena. An arena is created when you choose “Create arena”, after sign-in if needed. You are responsible for keeping your Twitch account secure. Tell us promptly if you notice unauthorized use.
04Streamers' responsibilities
If you run an arena you are responsible for how you use it, including:
- having every right and licence needed to play, broadcast and make available the music you play on your stream (for example under Twitch's rules and applicable copyright law);
- moderating submissions and removing tracks or content that break these Terms or the law;
- complying with the Twitch Terms of Service, Community Guidelines and Music Guidelines;
- making sure your branding, logo and text do not infringe anyone's rights.
We are not responsible for what is played or shown on your broadcast. A music subscription, purchase, or an available embed does not by itself grant permission to rebroadcast music. Before collecting chat votes, tell participants that their Twitch nickname and vote are sent to TRACKFIGHT, may be displayed publicly, and are covered by our Privacy Policy. Link to that policy in your channel information or voting instructions.
05Submissions and content
You keep the rights to the content you provide (for example a logo, names and text). You grant us a worldwide, non-exclusive, royalty-free licence to host, process and display it solely to operate and promote the Service (for example on arena pages and in link previews), for as long as the content is on the Service. Track titles, artists and cover images shown in the Service belong to their respective owners and are fetched from third-party sources. You confirm that you have the right to submit what you submit.
06Copyright and content reports
To report allegedly unlawful or infringing content on the Service, email support@trackfight.app. Include the arena URL, the specific content or track, a description of the issue or protected work, your contact details, and evidence of your authority to act if you represent someone else. For a copyright report, include a statement that you believe in good faith the use is unauthorized and that the information you provide is accurate.
We review reports and may restrict or remove content or accounts under these Terms and applicable law. If you believe a restriction is mistaken, contact the same address with the relevant details. Content hosted on a music provider or Twitch may also need to be reported directly to that platform.
07Acceptable use
You agree not to:
- submit or display content that is illegal, hateful, harassing or sexually explicit, or that infringes someone's rights;
- manipulate votes, use bots or multiple accounts to influence results, or otherwise cheat;
- try to access data or accounts that are not yours, or probe, overload or disrupt the Service;
- scrape or copy the Service at scale, or reverse engineer it, except as the law allows;
- use the Service to violate the terms of Twitch or any other third-party service;
- impersonate another person or misrepresent your affiliation.
08Third-party services
The Service works with Twitch, YouTube, Spotify, SoundCloud and Apple. We are not affiliated with or endorsed by them. Their own terms and policies apply to your use of their services, and we are not responsible for their content, availability or changes.
09Our intellectual property
The Service, including its software, design and the name TRACKFIGHT, belongs to Yevhen Besiedovskyi or its licensors and is protected by law. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service under these Terms. Third-party components are used under their own licences.
10Availability and changes
The Service is provided free of charge and may change, be interrupted or be discontinued at any time. We may add, change or remove features. Where possible we will give reasonable notice of significant changes. Any future paid features will have their price and applicable payment, cancellation and refund terms disclosed before purchase. These Terms do not authorize automatic charges.
11Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, uninterrupted operation or freedom from errors.
12Limitation of liability
To the fullest extent permitted by law, Yevhen Besiedovskyi is not liable for any indirect, incidental, special or consequential damages, or for loss of data, profits or reputation arising from your use of the Service, including claims related to music played on a stream. Nothing in these Terms limits liability that cannot be limited by law, or your mandatory rights as a consumer.
13Suspension and termination
You may stop using the Service at any time and ask us to delete your data (see the Privacy Policy). We may suspend or terminate your access, or remove an arena or content, if you breach these Terms, if the law requires it, or to protect the Service and other users.
14Governing law
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. This does not deprive you of the mandatory consumer protection rules of the country where you live. We will first try to resolve any dispute amicably; if that fails, it will be decided by the competent courts.
15Changes to these Terms
We may update these Terms. The date of the latest version is shown at the top. If you keep using the Service after a change takes effect, you accept the updated Terms. If you do not agree, stop using the Service.
